AI Tools Terms

These AI Tools Terms (“Terms”) govern your use of any and all AI Tools offered by DreamHost, including but not limited to the Business Advisor and the Business Name Generator (“AI Tools”), in addition to the General Terms of Service, Privacy Policy, Acceptable Use Policy, and other applicable terms and conditions.
Violation of any such terms may at DreamHost’s sole discretion result in suspension or disablement of Services up to and including account termination.
By continuing to use DreamHost’s AI Tools, you affirm that you have read and agree to the Terms.
I. Content
A. User Input
Your privacy is extremely important to us at DreamHost. While DreamHost may utilize third-party vendors to assist in providing you with such AI Tools, your inputs will not be used to train those external AI models. By interacting with the AI Tools, you authorize that the inputs you provide (and the corresponding outputs) may be recorded and stored for the purposes of improving DreamHost services, enhancing the AI Tools' performance within the DreamHost ecosystem, and ensuring compliance with our terms and conditions. You acknowledge that you are solely responsible for any and all inputs that you provide to the AI Tools. You represent and warrant that you have all rights, licenses, and permissions necessary to provide such inputs.
B. AI Tools Output: Our AI Tools use machine learning and automated systems to generate drafts, suggestions, and other content ("Output"). The AI Tools are not infallible and may produce Output that is inaccurate, incomplete, biased, outdated, or not appropriate for your specific circumstances, jurisdiction, or intended use.
You acknowledge and agree that you will not rely on any AI Tools Output as a sole source of truth or as a substitute for professional advice, including legal advice. If the Output relates to legal or compliance matters, you are solely responsible for reviewing, verifying, and customizing the Output, and for obtaining advice from a qualified professional as needed before publishing or relying on it.
DreamHost makes no representation or warranty, express or implied, regarding any Output, including that the Output is (1) accurate, complete, or reliable; (2) fit for a particular purpose; (3) legally valid, enforceable, or compliant with applicable laws; or (4) non-infringing on third-party intellectual property rights.
Due to the nature of AI systems, Output may not be unique, and other users may receive similar Output.
You are solely responsible for (1) any information, text, or materials you provide to the AI Tools as input, (2) how you use any Output, and (3) ensuring that your Input and Output, and your use thereof comply with applicable laws and do not infringe, misappropriate, or otherwise violate any third-party rights, including intellectual property and privacy rights.
To the extent permitted by applicable law and subject to these Terms, you own the Output generated by the AI Tools. However, use of the AI Tools does not grant you any ownership rights over the AI Tools or the underlying models, software, or technologies used to generate such Output. You agree to grant DreamHost a non-exclusive, perpetual, irrevocable, worldwide, fully paid, and assignable license to use, reproduce, modify, create derivative works from, and otherwise process your Input and Output to improve and promote the Services, including featuring generated websites, or screenshots thereof, for marketing materials such as on our website, blog, social media channels, and sales materials. DreamHost will honor reasonable requests to remove featured content from future marketing uses.
II. Limitation of Liability; Indemnification; Remedy:
By using DreamHost’s AI Tools, you acknowledge and agree that DreamHost is not responsible for any decisions, actions, or outcomes that may result from your interaction with DreamHost AI Tools. You acknowledge that DreamHost, its affiliates, employees, and any other agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your use of DreamHost AI Tools.
By using DreamHost’s AI Tools, you also agree to indemnify and hold harmless DreamHost, its affiliates, employees, and any other agents from and against claims, losses, expenses (including attorneys’ fees) arising from or relating to your use of the AI Tools, including your subsequent use of any content (i.e. output) from the AI Tools and your breach of these Terms, the General Terms of Service, the Acceptable Use Policy, or any violation of applicable law.
If you do not agree with these Terms, your sole remedy is to discontinue use of DreamHost AI Tools.
